Terms & Conditions
Last updated: August 2025. These terms govern all orders placed through JST Wine & Spirits.
1. Who We Are
JST Wine & Spirits is operated by Jean-Sébastien Tisserand, doing business as JST Wine and Spirits (“JST,” “we,” or “us”), licensed by the Alcohol and Gaming Commission of Ontario (AGCO) as a Manufacturer's Representative (Licence No. LRM1539885) under the Liquor Licence and Control Act, 2019. JST facilitates private co-importation of wine and spirits for personal use and does not sell alcohol directly. All arrangements are made on a client's behalf in accordance with Ontario law and AGCO regulations.
2. Acceptance of Terms
By submitting an inquiry, placing an order, or otherwise engaging JST's services, you agree to these Terms & Conditions in full. If you do not agree, please do not use this website or engage our services. We reserve the right to update these terms at any time; the version in effect at the time your order is confirmed governs that transaction.
3. Eligibility
You must be 19 years of age or older to place an order or access services through JST Wine & Spirits. By proceeding, you confirm that you meet this requirement. JST reserves the right to cancel any order where age cannot be verified on delivery.
4. Order Process
Orders are initiated through inquiry forms or direct communication with JST. Submission of an inquiry or order form does not constitute a binding contract. A contract is formed only when JST sends a written order confirmation (by email or other written means) confirming product availability, pricing, and estimated delivery. Until that confirmation is issued, JST may decline any order for any reason, including but not limited to product unavailability, regulatory constraints, or inability to verify buyer eligibility.
5. Payment
Payment terms are set out in the order confirmation. Orders must be paid in full before shipment is arranged unless otherwise agreed in writing. Accepted payment methods are confirmed at the time of order. All amounts are in Canadian dollars. JST reserves the right to cancel an order if payment is not received within the timeframe specified in the confirmation.
6. Pricing & Pricing Errors
Prices shown on this website or provided in quotes are estimates based on current conditions and are subject to change prior to order confirmation. If a pricing error is discovered after confirmation — for example, due to a typographical error or currency fluctuation — JST will notify you and offer the choice to proceed at the corrected price or cancel for a full refund of any amounts paid. JST is not obligated to fulfil an order at an erroneous price.
7. Right to Refuse an Order
JST reserves the right, at our sole discretion, to refuse or cancel any order at any time, including after confirmation, for reasons including but not limited to: product becoming unavailable from the producer, AGCO regulatory restrictions, inability to verify the buyer's age or identity, or concerns about intended use. In such cases, any amounts paid will be refunded in full.
8. Intellectual Property
All content on this website — including text, images, producer descriptions, tasting notes, the JST name and logo, and the overall look and feel of the site — is the property of JST Wine and Spirits or is used with permission. You may not reproduce, distribute, or use any content from this site for commercial purposes without prior written consent from JST.
9. Limitation of Liability
To the maximum extent permitted by Ontario law, JST's total liability to you for any claim arising from your use of our services or website is limited to the amount you paid for the specific order giving rise to the claim. JST is not liable for any indirect, incidental, special, or consequential damages, including lost profits, loss of data, or damage to reputation. Nothing in these terms excludes liability that cannot be excluded under applicable law.
10. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute arising from or related to these terms or your use of JST's services shall be subject to the exclusive jurisdiction of the courts of Ontario. Before initiating formal proceedings, we encourage you to contact us directly — most issues can be resolved quickly through conversation.
